1. Use of this website
You may use this website for lawful, personal purposes, such as viewing our menus, making enquiries and booking a table. You must not:
- use the site in a way that breaches any law or infringes anyone’s rights
- attempt to gain unauthorised access to the site, its servers or its data
- introduce malware or interfere with the site’s operation
- scrape, copy or harvest content or data by automated means without our written permission
- submit false, misleading or offensive information through our forms
2. Information on this site
We take care to keep menus, prices, opening hours and other information accurate and current, but we don’t guarantee that it is complete or error-free. Menus and prices change with the seasons and supply, and may differ from what appears online. Please confirm details with us directly where they matter to you.
3. Bookings
- Bookings are subject to availability and are confirmed only once you receive a confirmation from us or our booking platform.
- Please let us know of any changes to your party size as early as possible. We may release your table if you are more than [15] minutes late without contacting us.
- For larger groups (more than [number] guests), set menus, deposits or minimum spends may apply. These will be advised at the time of booking.
- Where a deposit or cancellation fee applies, it will be disclosed before you confirm your booking.
- Dining times may be limited to [duration] during busy periods.
- We may need to modify or cancel a booking due to circumstances beyond our control. If so, we’ll contact you and offer an alternative or refund any deposit paid.
4. Cancellations and no-shows
Please give us at least 48 hours’ notice to cancel or change a booking. Late cancellations or no-shows may incur a fee of [amount] per person, or forfeiture of any deposit paid, where this was disclosed at the time of booking. Genuine emergencies will be considered case by case.
5. Private dining, functions and events
Function and event bookings are subject to a separate agreement or confirmation setting out pricing, deposits, minimum numbers and cancellation terms. If those terms conflict with these Terms & Conditions, the separate agreement prevails.
6. Dietary requirements and allergens
Please tell us about any allergies or dietary requirements when you book and again when you order. We take reasonable care, but our kitchen handles common allergens, including gluten, dairy, eggs, nuts, shellfish and fish, and we cannot guarantee that any dish is completely free from traces of them.
7. Gift vouchers
- Gift vouchers are valid for a minimum of three years from the date of purchase, as required by Victorian law, and the expiry date is shown on the voucher.
- Vouchers are redeemable for food and beverage at SUD, are not redeemable for cash and cannot be replaced if lost or stolen, unless required by law.
- Vouchers cannot be used for [exclusions, e.g. functions, other vouchers] unless agreed in advance.
- Any remaining balance stays on the voucher until it expires.
8. Pricing and payment
Prices are in Australian dollars and include GST unless stated otherwise. A surcharge may apply for card payments and on public holidays, and will be displayed in the venue and on our menu. Online payments are processed securely by third-party providers, and we do not store your full card details.
9. Intellectual property
All content on this website, including text, photography, menus, logos, branding, graphics and design, belongs to us or our licensors and is protected by copyright and other intellectual property laws. You may view and print pages for personal use. You must not reproduce, modify, distribute or commercially exploit any content without our written permission.
10. Your content and communications
If you send us reviews, photos, comments or other material, you confirm that you have the right to share it and grant us a non-exclusive, royalty-free licence to use it for promoting SUD, with credit where reasonably practicable. We may remove content that is unlawful, offensive or misleading.
11. Third-party links and services
This site may link to third-party sites and services, including booking platforms, payment providers and social media. We don’t control them and aren’t responsible for their content, availability or privacy practices. Your use of them is at your own risk and subject to their terms.
12. Privacy
We handle personal information in accordance with our Privacy Policy.
13. Disclaimer and limitation of liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the extent the law allows:
- the website is provided “as is”, and we don’t guarantee it will be uninterrupted, secure or error-free
- we are not liable for any indirect or consequential loss arising from your use of, or inability to use, the website
- where our liability cannot be excluded, it is limited, at our option, to resupplying the services or paying the cost of having them resupplied
14. Indemnity
You agree to indemnify us against any loss or claim arising from your breach of these terms or your misuse of the website, to the extent permitted by law.
15. Changes to the site and these terms
We may update the website or these Terms & Conditions at any time. The current version will always be on this page, and continued use of the site means you accept the updated terms.
16. Governing law
These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
